EventWatch Terms &Conditions

These terms & conditions apply to EventWatch.com.au , the use of  “the Site” or “EventWatch”  throughout the document is taken to mean EventWatch.com.au and content that has originated from EventWatch.com.au.

EventWatch.com.au is owned and operated by EventWatch Pty Ltd (ABN 85 106 675 138), a wholly owned Australian Company.

Future changes: EventWatch aims to be the leading provider of online event promotion services. Therefore we will periodically be improving and modifying the Site. Our terms and conditions will be reviewed and may be revised. EventWatch reserves the right to change its policies at any time, an updated version of the policies will be posted on the Site. Your continued use of the Site will show your acceptance of the policy in place at that time.

Refunds: Refunds will not be given once an event has been confirmed on the Site, this includes, but is not limited to, such things as an event being cancelled or postponed, however if you have any concerns surrounding your account we ask that you email our Customer Service Department and discuss your concerns with them as a number of resolutions may be available to you regarding your particular situation.  Should there be a need to terminate you as a user for violating any of the EventWatch Terms and Conditions EventWatch is not required to provide any refund of unused credits (i.e. payment in advance for event promotion).

Pricing:  All prices quoted on the site are quoted in Australian dollars and are inclusive of G.S.T.

Permitted Use: The Site is only to be used for your own personal, non-commercial use to review event and promotional information, and may not be used for any other purpose unless otherwise specifically authorized, in writing by EventWatch. It may not be copied, reproduced, published, saved or transmitted in any form in whole or part .

Content Syndication: If implementing a Content Syndication option in your website, you agree that the content remains the property of EventWatch and cannot be modified in any way. EventWatch retains the right to refuse access to content syndication products and EventWatch content.

Content in the 'Event Scrollers' is the property of EventWatch and cannot be copied or reproduced in other formats.  Event Scrollers MUST contain a reference to 'EventWatch.com.au' and MUST be hyperlinked to 'http://www.eventwatch.com.au'. Event Scrollers are provided free of charge to 3rd party web sites for your benefit and ours.

Content: Please be aware that the content displayed on EventWatch or syndicated to other web sites does not necessarily represent the view or opinions of EventWatch. EventWatch will monitor the event content by way of a vetting process, events will only be approved when they have been checked, usually within 24 hours of being confirmed by the event administrator, any content deemed unsuitable will, whether found through the initial vetting process or at any later time, and at the sole discretion of EventWatch staff or their agents, be blocked.  It is an offence to use any information obtained from this Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit or sell to any User without their prior explicit consent.

The following is the kind of content which is illegal, prohibited or unsuitable for the Site, it includes material that:

 promotes information that you know is false, misleading, or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
 is patently offensive to the online community, such as content that promotes racism, bigotry , hatred or  physical harm of any kind against any group or individual;
 harasses or advocates harassment of another person;
 displays pornographic or sexually explicit material of any kind;
 provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18 or could be harmful to minors.

Liability:   By logging on, you will have deemed to have released and discharged EventWatch from all liability, which might arise resulting from your access to, use or inability to use the Site and its contents, including indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits, even if EventWatch has been advised of the possibility of such damages.  Information on the Site is provided by the organisers or other interested parties of the events or activities and whilst considerable effort is made to validate the accuracy of the information, the owners of the Site are in no way liable for any loss or damage incurred as a result of using the Site.

EventWatch accepts no responsibility for the accuracy of information or material accessed through the site or it's syndicated partners.  No liability is accepted to any person for loss or damages, including indirect or consequential, incurred as a result of reliance upon material found on the website. 

By logging on, you will be assuming all risks associated with use of the site, including risk to your computer, software or data being damaged by any virus which might be transmitted or activated via the EventWatch site or your access to it.

Indemnity: You agree to indemnify and hold EventWatch, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.

Disclaimers: EventWatch does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site or any content, search or link on it. The Site and its content are delivered on an "as-is" and "as-available" basis. EventWatch cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. EventWatch makes no guarantee of any specific result from use of this Site. EventWatch disclaims any and all liability for the acts, omissions and conduct of any third party users, EventWatch users, advertisers and/or sponsors on the Site, in connection with this service or otherwise related to your use of the Site. EventWatch is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the Site.

Links and Search Results: The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. EventWatch has no control over these sites or the content within them. EventWatch cannot guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. EventWatch does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against EventWatch for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, please notify us at support@eventwatch.com.au and we will investigate your claim and take any actions we deem appropriate in our sole discretion.

These terms do not affect the statutory rights of consumers.
